I will ensure to the best of my abilities that I will continue to comply with all local, state and federal and/or laws from the place(s) where I access, send, receive, interact and/or use the services and/or facilities of MOUNT EQUINOX INC. with reference to the material of the nature mentioned in paragraph one (1) of this document. That I will not reveal, rent, sell, display, give, loan, show or post (via any medium) the above mentioned types of materials that I have accessed and/or obtained from MOUNT EQUINOX INC.. That I will not reveal, rent, sell, display, give, loan, show or cause to be seen the same by any minor under the age of twenty-one (21) or to anyone that may be offended by such material and that I am solely responsible for any and all materials that I access and/or obtain from MOUNT EQUINOX INC..

That I will not sell, rent, give, loan, display, reveal or post (via any medium) my User ID or password which allows me access to the MOUNT EQUINOX INC. to any adult or minor, under twenty-one (21) years of age. That I will keep such access codes in a safe and protected area. I further agree that any charges incurred through the mis-use of my User ID and password or from third parties shall be my sole responsibility. That I agree that MOUNT EQUINOX INC. will not be responsible for any liabilities, damages, (direct, indirect, consequential or otherwise,) costs, and expenses which MOUNT EQUINOX INC. may occur by reason of any action and/or inaction, either deliberate or in-deliberate, that I might cause to breach this agreement.

(8.) As a Patron of MOUNT EQUINOX INC. I agree that all material found on the MOUNT EQUINOX INC. is copyrighted under the laws of "compilation copyright". This compilation copyright protection of the contents and components of MOUNT EQUINOX INC. include the form, style, organization, methods, materials, resources, services and/or facilities that constitute the MOUNT EQUINOX INC..

(9.) I expressly agree that the use of access to MOUNT EQUINOX INC. is at my sole risk. I understand that neither MOUNT EQUINOX INC., its' owners, employees, suppliers, contractors, resources, services and/or facilities of MOUNT EQUINOX INC., make any warranty as to what may be obtained from access to MOUNT EQUINOX INC.. That materials are distributed on a "as is" basis without warranty of any kind, either express or implied, including but not limited to, warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement. Neither MOUNT EQUINOX INC. nor any person or entity involved in MOUNT EQUINOX INC. shall be liable for any direct, indirect, incidental or special damages arising out of use of MOUNT EQUINOX INC. or inability to use MOUNT EQUINOX INC. or any breach of warranty. As a Patron I also expressly agree that the provisions of this paragraph shall also apply to any third (3rd) party contracts.

That I agree that ANY material including and/or computer or similar data I obtain via electronic transfer, postal services (mail in any form), or any other source of information originating from MOUNT EQUINOX INC that I do so at my own discretion and risk. I will indemnify and hold harmless MOUNT EQUINOX INC its owners, employees, agents, contractors and/or representatives for any damage caused to my computer system or myself and/or persons I might be affiliated with from my direct or indirect transferring of materials and/or data by my accessing and/or contact with MOUNT EQUINOX INC..

That if I fail to comply with any and all of the statements made in this document and/or conditions, and/or terms that I will indemnify and hold harmless MOUNT EQUINOX INC., any and all of its' owners, employees, contractors, agents, representatives and/or any and all known and unknown contracted entities.

(11.) I agree that if any provision of this Statement and Agreement is held by any court to be invalid, void or unenforceable, the remaining provisions nevertheless continue in full force and effect. Additionally, that this document shall be construed under the laws of The State of New York and the courts in the State of New York shall have sole legal jurisdiction over any controversy relating to any and all portions and/or provisions of this document.

(12.) I DO NOT work for any LAW ENFORCEMENT AGENCY, FEDERAL, STATE, or LOCAL, in any capacity, directly or indirectly. (Note: If you obtain access to this site by providing payment Information and answer this question UNTRUTHFULLY, to investigate or obtain access to this service, YOU OR YOUR AGENCY WILL AGREE TO DISMISS Mount Equinox INC. and its members and owners from all liability in providing the content within this site or service).
